We are able to represent both Landlords and Tenants and we can provide guidance, advice and assistance in the following areas:
 
Possession - rent arrears.

If you are tenant facing court proceedings by your landlord because you are in rent arrears for failing to pay your rent, then we can advise and represent you in trying to retain your home and effectively manage any debt. Payments relating to your home should always be your main priority. We can advise you on all aspects of the court procedure and negotiate with your Landlord. Even where a court order has been made the repossession may still be prevented. You need to act quickly. An order for possession can be avoided with the right help.

If you are an owner occupier facing repossession because you are in mortgage arrears having failed to pay your mortgage, we can advise and represent you to protect your home and effectively manage any debt. Possession - Anti social behaviour.

As a tenant or other occupier you can be evicted from your property for anti social behaviour. Your landlord may bring proceedings against you and you could be made homeless. We can advise and represent you in defending such possession proceedings. We can also assist tenants or other occupiers who are subjected to anti social behaviour including those who have been threatened with violence. An order for possession can be avoided with the right help.
 
Unlawful Eviction.

Unlawful eviction is when your landlord or any other person tries to force you from your home without taking the necessary legal action. They may have prevented you in some way from using the property by changing the locks or moved your possessions out of the home. It will also include harassment. If you are a victim of an unlawful eviction we can help you take legal action against your landlord. Through the civil courts you can apply for an injunction which is an order of the court to be reinstated in your home, potentially obtain damages for your landlord's behaviour and to stop the harassment. An unlawful eviction is a serious offence and constitutes a criminal act.

Homelessness.

If you are homeless or faced with the possibility of being made homeless we can provide advice and assistance to uphold and advance your legal rights. Homelessness means not having a home. This does not mean you are living on the street but that you may not have suitable accommodation or you have no rights to stay where you live. We assist clients with applications to the local authorities and challenging
local authority decisions if there are grounds to do so. We may be able to assist you with staying in your home or finding you a new home.Homelessness can be avoided with the right help.

Housing
Disrepair.

If your property is in a state of disrepair we can assist with obtaining possible remedies such as specific performance injunctions, which is an order of the Court requiring your Landlord to deal with the repairs within a reasonable time and also pay you damages. This is to compensate you for any loss and inconvenience. We also assist in claiming for personal injury and consequential loss arising out of exposure to unsuitable housing conditions. See our Personal Injury Department. Our experienced solicitors have assisted tenants with claims for carbon monoxide poisoning and respiratory problems.
 
Housing Benefit.
 
We provide advice and assistance in relation to the Housing Benefit System. Tenants in receipt of Housing Benefit find this area extremely complex. We assist our clients with their claim and assist with challenging decisions where necessary and you may be able to secure backdated Housing Benefit. We similarly assist private tenants with the new Local Housing Allowance Benefit.
 
Landlord and Tenant Issues.
 
We can advise both landlords and tenants in relation to any issue arising out of their involvement with each other and advise on the best course of action to settle the dispute amicably benefiting both parties and more often than not without involving the court.

The Practice has a full legal aid franchise in housing matters and so full advice is given at the outset as to the availability of legal aid subject to the standard financial eligibility requirements.
